The Contract Offer Document Terms and Conditions


Repayment Method
The customer agrees to repayment by way of direct debit facility, from the customer’s bank account nominated and confirmed as receiving the customer's income, on the due instalment dates.


Personal Financial Information
In negotiating this contract, the customer has provided, at Cash Australia's request:

A current bank statement.

The customer attests that he/she has been truthful and fulsome in revealing his/her personal financial circumstances.


Privacy Policy
Cash Australia guarantees that all information provided by the customer, in association with this Personal Cash Advance Contract, shall be used by Cash Australia only for the primary purposes of:

Assessing whether to make this offer/enter into the contract;

Administration of the loan; and in the event that the customer breaches or defaults, to facilitate collection of all outstanding money.


Breach or default
In the event that the customer breaches or defaults, under this contract, the customer hereby agrees to pay -

Re-scheduling of repayment date/administration fee/costs of $29.00 for each payment, unpaid when due.

Such re-scheduling, to a future date/s when a deposit of the customer’s pay is anticipated, to be attempted at the lender’s sole discretion for a period of up to 365 days after the breach or default, whether or not there is one or more future repayment date/s already scheduled under this contract. Any outstanding amounts to be paid, in full, on the selected later date/s and/or

Direct debit dishonour payment charge of $29.00 for each dishonoured payment.

Such occurring in circumstances where a direct debit is denied because of insufficient funds; and/or

Other expenses as may reasonably be incurred, by Cash Australia, in facilitating collection of outstanding money.

Such expenses, fees and charges shall be due and payable in total on, or before, the date of the next repayment instalment, or on or before the date/s as may be determined in accordance with Changed Financial Circumstances below, as otherwise specified by the lender or, in the absence of such date, within 30 days of the breach or default. In the event of such payment in total not being received by Cash Australia on, or by, the due date/s, Cash Australia reserves the right to recover all money owed by way of prosecution in the relevant court or tribunal and Cash Australia will seek recovery of the loan, interest and all legal and administrative costs incurred, in full, in utilising the services of solicitors and/or debt collection agencies.


Other Dishonour Fee/s
You may be charged dishonour fees by your financial institution, should you default on your repayment resulting in a declined direct debit.


Changed Address/Contact Details
In the event of changes to the customer’ address, or other contact details, during the period of the loan, the customer hereby agrees to contact Cash Australia at the earliest possible occasion after such change has occurred, to inform the lender of such changes.


Changed Financial Circumstances
In the event of the customer’ financial circumstances adversely changing, during the period of the loan, the customer hereby agrees to contact Cash Australia at the earliest possible occasion after such change has occurred. Where a direct debit facility is the repayment method, such contact must be made at least 24 hours before the prescribed repayment date.

Only in such adverse circumstances, and subject to agreement by both the customer and Cash Australia, will the terms of this contract be varied.


ACCEPTANCE OF PERSONAL CASH ADVANCE CONTRACT LOAN OFFER


The applicant
Understands that, until the Personal Cash Advance Contract document is emailed back to Cash Australia as acceptance by the customer, it constitutes an offer only and is regarded as a Pre-contractual Statement;

Has read and understood the Information Statement and this Personal Cash Advance Contract;

Understands that a copy of the Information Statement and this Personal Cash Advance Contract can be printed by the applicant to keep;

Has been advised by Cash Australia to consider obtaining independent legal and financial advice regarding this offer/contract;

Has a reasonable belief that it will be financially possible to repay the Personal Cash Advance and credit fees and charges, on the due dates; and

Accepts the Personal Cash Advance Contract loan offer, which is not contingent on using any other Cash Australia service, and agrees to the terms and conditions as set out in this Personal Cash Advance Contract.


BEFORE YOU ACCEPT
You should also read the Information Statement: “THINGS YOU SHOULD KNOW ABOUT YOUR PROPOSED CREDIT CONTRACT”.

READ THIS PERSONAL CASH ADVANCE CONTRACT OFFER DOCUMENT carefully, so that you know exactly what contract you are entering into and what you will have to do under the contract.

Print a copy of the final contract document.

Do not accept the contract document if there is anything you do not understand. Do not hesitate to ask questions of Cash Australia.

Remember – you can take this contract offer document to a solicitor and/or other professional advisor of your choice, to obtain independent advice before you accept.


THINGS YOU MUST KNOW
Once you signify your acceptance of this contract document, you will be bound by it. However, you may end the contract before you obtain any credit by advising Cash Australia in writing, but you will still be liable for any fees or charges already incurred.

Cash Australia does not require you to take out credit insurance.

The contract does not involve mortgaged property.

Cash Australia does not charge a fee if you pay out your contract early.


Direct Debit Request Form
If this is your first loan from Cash Australia, or you are due to renew your annual membership you must fax to Cash Australia a signed Direct Debit Request Form

In order to activate your loan and to enable us to deposit the loan money to your bank account, you must print out and complete the Direct Debit Request Form that is an attachment to your Loan Proposal Document. Once you have signed and dated the form, fax it to Cash Australia at (08) 8252 6221.

When cash Australia receives your Direct Debit Request Form, You will receive an activation email informing you that the money has been transferred to your bank account.
